I suspect that the Fux Noise confidentiality agreement—-having been drafted by the Fux Noise legal staff——on its face prohibits an ex-employee from disclosing anything at anytime to anyone. The issue would be just how enforceable the agreement would be in court. If the employee quit, I suspect that a court would enforce it. If an employee was fired for just cause (e.g. poor work performance), I also suspect that the confidentiality agreement would be enforced. However, if an employee was unjustifiably terminated (e.g. because of unlawful discrimination, for being a whistle-blower, etc.), I would suspect that a court would declare the agreement to be unenforceable as a matter of public policy. Maybe we will find out if and when Lewis and Jabba end up in court. I still believe that they will likely reach a monetary settlement before the case is tried.
