FIred Fox Exec, Brian Lewis, Lawyers Up

Brian Lewis, that former "right-hand man" to Fox News chief Roger Ailes who was fired and escorted out of the building - allegedly because he leaked to Ailes critic and forthcoming biographer, Gabriel Sherman - has now retained a high-profile lawyer and is threatening to spill secrets.

According to Gawker, Lewis has retained Judd Burstein, an entertainment lawyers whose past clients include Donald Trump and the Backstreet Boys.

But here's where it gets interesting. In a statement to Gawker, Burstein said he is "still plotting our course of action." But then he made this not-so-thinly-veiled threat:

But two things are very clear to me. First, Brian Lewis no longer has any confidentiality obligation to Newscorp or Roger Ailes because of the false and malicious statements made by Fox to date. Second, Roger Ailes and Newscorp have a lot more to fear from Brian Lewis telling the truth about them than Brian Lewis has to fear from Roger Ailes and his toadies telling lies about Brian Lewis.

I, too, think this is about money. Before the lawyer arrived on the scene, Lewis was very complimentary about Ailes. http://www.mediabistro.com/tvnewser/brian-lewis-talks-about-his-fox-news-firing_b192709

However, if it’s true Lewis leaked to Sherman because he was uneasy with what Ailes has been up to and things remain acrimonious…

More importantly, I can’t wait to read the book!

@josephwest. Good points. I suspect that the Fux Noise confidentiality agreement—-having been drafted by the Fux Noise legal staff——on its face prohibits an ex-employee from disclosing anything at anytime to anyone. The issue would be just how enforceable the agreement would be in court. If the employee quit, I suspect that a court would enforce it. If an employee was fired for just cause (e.g. poor work performance), I also suspect that the confidentiality agreement would be enforced. However, if an employee was unjustifiably terminated (e.g. because of unlawful discrimination, for being a whistle-blower, etc.), I would suspect that a court would declare the agreement to be unenforceable as a matter of public policy. Maybe we will find out if and when Lewis and Jabba end up in court. I still believe that they will likely reach a monetary settlement before the case is tried.

Truman, I’m not really sure but I think, in most cases, confidentiality agreements only last when BOTH parties agree to part company. When a person’s been fired (and seemingly with little real cause), that’s enough reason to render the agreement null and void—especially on the part of the person who was fired.

A standard negotiating ploy. Threaten disclosure of Jabba the Ailes’ deep dark secrets. Use that threat as leverage for a generous severance package. Jabba will counter with angry threats to sue for breach of the confidentiality agreement and slander. Could get very interesting. But I suspect that Jabba will ultimately buy his way out his predicament.

These frauds don’t like their secrets spilled to the public. What they do is pay off their former employees with a settlement.

NOTE TO BRIAN

Don’t let that foul-mouth Ailes pay you off! Tell the world of what he has done. He threw you under the bus, now throw him under the bus. Tell the masses about the Second Floor meetings, the War Room meetings, the anchors’ double standards, who’s doing who, and the rest of the gems.
