Marc Racicot's "truth" check doesn't hold up on factcheck.ORG

Minutes after the second presidential debate ended this evening, Bush/Cheney campaign manager Marc Racicot spoke with Chris Wallace on FNC.
(Note: I have no tape of this, only quick notes, so there are no direct quotes, just the gist of the conversation.)
Chris Wallace pointed out that Senator Kerry mentioned Marc's name as someone on the Republican side who agreed with him, Kerry, that the Patriot Act should be revised. Marc denied that he agreed with Kerry, and Chris ended the conversation with something like "instant truth check", thank you.
A quick Google of "Marc Racicot Patriot Act" shows that he does (or at least did, if he has since flip-flopped) believe the Act could use some refining. Just a few documents:

Comment: It seems like the topic was brought up explicitly to allow Racicot to deny it, and to paint Kerry as a liar. Most FOX watchers will think it's another "gotcha" on Kerry when in reality it's their guy lying and FOX enabling it.
